Plain-language summary
Emelyn is an early product. Use it lawfully, protect your account, review output before relying on or publishing it, and only provide content you are allowed to use. We will be candid about scope, pricing, and material changes before asking you to commit.
1. Agreement and who “Emelyn” means
These terms apply when you create an account for, access, or use the Emelyn website or service. “Emelyn,” “we,” and “us” refer to the people operating the Emelyn service. If you receive a paid offer, that offer will identify the legal contracting entity before you accept it.
By using the service, you confirm that you can enter this agreement for yourself or the organization you represent. If you do not agree, do not use the service. A written order or pilot agreement signed by both sides controls where it expressly conflicts with these terms.
2. The service and its current status
Emelyn is a developing service. Features, supported channels, capacity, integrations, and workflows may change as we learn. We will not describe an unconfirmed capability as included in the service.
Information shown in the service or included in a written offer should identify the workflow, supported formats and channels, review model, included capacity, material constraints, support expectations, and any fees that apply. Please evaluate whether the service remains suitable before using it for important publishing decisions.
3. Accounts and access
Provide accurate account and contact information, keep credentials confidential, and promptly tell us about suspected unauthorized access. You are responsible for activity performed through your account by people you authorize.
Do not share access outside your authorized organization, bypass access restrictions, or attempt to use another customer’s workspace. We may limit or suspend access to protect the service, other customers, or data while we investigate a credible security or misuse concern.
4. Your content, instructions, and output
You retain the rights you already have in content, brand materials, instructions, and other information you provide. You give us a limited permission to host, process, transmit, and display that material only as needed to provide, secure, support, and improve the service as described in the applicable privacy notice and written scope.
You are responsible for having the rights and permissions needed to provide that material. You are also responsible for reviewing generated drafts and final output for accuracy, legality, brand fit, required disclosures, and third-party rights before relying on or publishing it. Generated output can be incomplete, incorrect, or similar to material created for others.
Feedback about the product is voluntary. You allow us to use feedback to improve Emelyn without an obligation to compensate you, but this does not give us ownership of your confidential content or brand assets.
5. Acceptable use
You must not use Emelyn to:
- break applicable law, violate another person’s rights, or facilitate fraud or deception;
- publish unlawful harassment, exploitation, malware, or content intended to cause harm;
- send spam, create inauthentic engagement, or evade platform rules and rate limits;
- probe, disrupt, overload, reverse engineer, or bypass security controls except where law expressly permits;
- submit secrets or sensitive personal information that the agreed workflow does not require; or
- represent generated content as independently verified when it has not been reviewed.
We may ask you to stop a use that creates legal, security, platform, or reputational risk. We will explain the concern where doing so would not compromise an investigation or another person’s safety.
6. Third-party services
Your workflow may rely on social networks, data sources, hosting, artificial-intelligence providers, or other third-party services. Their terms, availability, and technical limits can affect Emelyn. We do not control those services and cannot promise they will continue to support a particular integration.
A written paid offer may identify material providers or integration terms relevant to the proposed workflow. You remain responsible for maintaining any third-party account and permission the workflow requires.
7. Fees, scope, and payment
Public access costs $0, with no subscription or metered usage charge. Creating an account does not create a paid commitment. Any paid offer must state the price, currency, billing timing, included scope, relevant limits, cancellation terms, and any applicable taxes or pass-through costs before you accept it.
If an agreed paid workflow changes materially, both sides should confirm any scope or price change before the additional work begins. A pricing conversation or account registration alone does not create a paid commitment.
8. Suspension and ending access
You may stop using the service at any time and may ask us to close your account. Any written paid offer will state cancellation timing, data-access implications, and amounts already due.
We may suspend or end access for material breach, non-payment under an accepted offer, security risk, unlawful use, or discontinuation of the service or a relevant offering. Where practical and safe, we will give notice and a chance to remedy the issue or retrieve eligible data.
Sections that logically need to continue—including ownership, payment obligations, responsibility for prior use, disclaimers, and dispute terms—remain effective after access ends.
9. Service disclaimers and responsibility
To the extent permitted by applicable law, the service is provided on an “as available” basis. We do not promise uninterrupted operation, a particular publishing result, audience growth, platform reach, or that generated output will be accurate or unique. Do not use Emelyn as a substitute for legal, financial, medical, or other professional advice.
Neither side excludes responsibility that applicable law does not allow it to exclude. Any negotiated warranty, service commitment, indemnity, liability cap, governing law, or venue for a paid service will be stated in the reviewed written offer presented before acceptance. Until then, please contact us before using the service where a failure could cause material loss or harm.
10. Changes, notices, and contact
We may update these terms as the service and legal framework mature. We will post the new effective date and give appropriate notice before a material change applies to an existing paid service. Continuing to use the service after the stated effective date means the updated terms apply, unless a signed agreement says otherwise.
Send questions about these terms to hello@emelyn.ai. You can also review how we handle personal information in our privacy notice.
